We Can Determine Legal Requirements

Immigrants who have been unlawfully in the United States were granted access to the I-601A provisional waiver in 2013 by the Department of Homeland Security, in an effort to keep families together and prevent separation for months or years at a time.

In order to qualify for the I-601A provisional waiver, the applicant must fulfill all of the following requirements:

  • Being 17 years or older
  • Being physically present in the U.S. to file your waiver
  • Having a case pending with the U.S. Department of State
  • Departing from the U.S. to obtain your immigrant visa
  • Being able to demonstrate that your absence will cause harm to the U.S. citizen
  • Being inadmissible for unlawful presence for more than 180 days but less than one year
